Herbert Smith Freehills Kramer concludes its series of analyses on AESIA’s Specialised Technical Guides for compliance with the European Artificial Intelligence Act

Herbert Smith Freehills Kramer has published a new issue of its Digital Law Sector e-bulletin, concluding the series of analyses dedicated to the 16 Specialized Technical Guidelines issued by the Spanish Agency for the Supervision of Artificial Intelligence (AESIA) for compliance with the European Artificial Intelligence Regulation.

This latest publication focuses on Guides 15 and 16, which address, respectively, the technical documentation of artificial intelligence systems and the checklist manual for requirements guidelines. Both issues are particularly relevant to the practical application of the AI Act, as they translate the Regulation’s general obligations into specific processes for documentation, traceability, self-assessment, and internal adaptation.

Guideline 15 emphasizes the importance of AI system providers having comprehensive technical documentation in place prior to the system’s marketing or commissioning, as well as mechanisms to keep it up to date throughout its entire lifecycle. For its part, Guideline 16 offers a self-assessment tool designed to help companies evaluate their level of compliance with the requirements applicable to high-risk AI systems and design an appropriate adaptation plan.

The analysis highlights one of the key aspects of the new European framework for artificial intelligence: regulatory compliance will require not only a thorough understanding of the Regulation, but also the ability to demonstrate its implementation through robust documentation, verifiable internal procedures, and appropriate system governance.
